We would like to inform you about the Law No. 6698 on the Protection of Personal Data (“LPPD”), which was enacted to protect the fundamental rights and freedoms of individuals, especially the right to privacy, in the processing of personal data and to determine the obligations of real and legal persons who process personal data.

Within the scope of the law, personal data is defined as “any information related to an identified or identifiable natural person”; and processing is defined as “any operation performed on personal data, such as obtaining, recording, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data, either fully or partially by automatic means or non-automatic means provided that it is part of any data recording system”.

1. Purpose of the Information Text and Our Company's Data Controller Position:

Our company ENWASOL, in order to fulfill the information obligation under Article 10 of the Personal Data Protection Law No. 6698 ("KVK") regarding personal data related to customers, presents the following explanations to the attention of our customers and third parties who use our websites. ENWASOL reserves the right to update this Personal Data Protection Explanation text at any time within the framework of possible changes in the current legislation.

2. Purpose of Processing and Transfer of Customer Personal Data:

Your personal data is used for the following purposes:

  • To confirm the identity information of those who shop/make purchases through our websites,
  • To record the address and other necessary information for communication,
  • To communicate with our customers regarding the conditions, current status and updates of the contracts we have concluded under the relevant articles of the Distance Sales Contract and the Law on Consumer Protection, to be able to provide the necessary information,
  • To organize all records and documents that will form the basis of the transaction electronically (internet/mobile etc.) or in paper format,
  • To be able to provide information to public officials upon request and as required by legislation on matters related to public security,
  • To provide a better shopping experience for our customers, to inform our customers about our products that our customers may be interested in by “taking into account the areas of interest of our customers”, to convey campaigns,
  • To increase customer satisfaction, to be able to recognize our customers who shop from our websites and use them in customer circle analysis, to be able to use them in various marketing and advertising activities and in this context, in the electronic environment through contracted organizations and/or conducting surveys in a physical environment,
  • To be able to offer suggestions to our customers by our contracted institutions and solution partners, to inform our customers about our services,
  • To be able to evaluate customer complaints and suggestions about our services,
  • To be able to fulfill our legal obligations and use our rights arising from the current legislation,
  • To be able to prevent fraud and other illegal activities.

Necessary technical and legal measures are taken to prevent rights violations during data transfer to third parties.

Your personal data, other than your license information, may be shared with our direct/indirect domestic/overseas subsidiaries, program partner institutions and organizations that we cooperate with to carry out our activities, domestic/overseas persons and organizations from whom we receive data storage services in the cloud environment, domestic/overseas organizations with which we have agreements regarding sending commercial electronic messages to our customers, the Interbank Card Center, and banks with which we have agreements.

3. Method and Legal Reason for Collecting Personal Data:

Personal data collected from www.enwasol.com.tr, websites or as a result of interviews with customer representatives are processed by ENWASOL with the consent of our customers and in accordance with the provisions of the legislation. Personal data collected for the legal reasons stated above can be processed and transferred for the purposes specified in Articles 5 and 6 of the Law and this Information and Consent Text.

4. Rights of Customers as Personal Data Owners:

According to Article 11 of the Law, data owners have the right to;

  • Learn whether personal data has been processed regarding them,
  • Request information regarding their personal data if it has been processed,
  • Learn the purpose of processing personal data and whether it is used in accordance with its purpose,
  • Know the third parties to whom personal data is transferred domestically or abroad,
  • Request correction of personal data if it is processed incompletely or incorrectly and request notification of the transaction made within this scope to third parties to whom personal data is transferred,
  • Request deletion or destruction of personal data if the reasons requiring processing are eliminated despite the fact that it has been processed in accordance with the provisions of the Law and other relevant laws and request notification of the transaction made within this scope to third parties to whom personal data is transferred,
  • Object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems and (viii) request compensation for the damages in case of damages incurred due to unlawful processing of personal data.

Requests regarding the use of such rights may be submitted to ENWASOL by personal data owners through the information available at www.enwasol.com.tr/tr/iletisim. ENWASOL will evaluate such requests and finalize them within 30 days.
